Welcome to Focus Up! These Terms and Conditions (“Terms”) govern your use of the Focus Up mobile application and website (the “Service”) operated by Joemer Ramos (“we,” “us,” or “our”).
By downloading, accessing, or using Focus Up, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Description of Service
Focus Up is a productivity application designed to help users minimize distractions. Core features include blocking specific applications (such as social media, video games, and messaging apps), setting daily time limits and weekly schedules, and utilizing “Accountability Partners” to manage app unlock requests.
2. Device Permissions
To function properly, Focus Up requires access to certain device settings and permissions, which may include screen time tracking, accessibility services, and device administration rights, depending on your operating system. By using the app, you consent to granting these permissions. You can revoke these permissions at any time through your device settings, though doing so will limit or disable the app’s core functionality.
3. Accountability Partners
Focus Up allows you to designate trusted individuals as “Accountability Partners.”
- User Responsibility: You are solely responsible for choosing who you add as an Accountability Partner.
- Delegated Authority: By assigning an Accountability Partner, you grant them the authority to approve or deny requests to unlock your blocked apps before your set timer expires.
- No Liability for Partner Actions: We are not responsible for any disputes, damages, or inconveniences caused by the actions or inactions of your Accountability Partners (e.g., if a partner refuses to unlock your phone, or unlocks it against your original productivity goals).
4. Limitation of Liability
Focus Up is designed as a personal productivity tool. Because the app intentionally restricts access to other applications on your device:
- Emergencies and Important Communications: You acknowledge that blocking messaging or communication apps may prevent you from receiving important or urgent notifications. You use this blocking feature at your own risk.
- No Warranties: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
- Limitation of Damages: In no event shall Joemer Ramos be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, loss of access to communications, or other intangible losses, resulting from your use of or inability to use the Service.
5. User Conduct and Abuse
You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. Attempting to exploit, bypass, or reverse-engineer the app’s blocking mechanisms outside of the intended features (like Accountability Partner requests) is prohibited.

7. Modifications to the Service and Terms
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also revise these Terms from time to time. The most current version will always be posted within the app or on our website. By continuing to use the Service after changes become effective, you agree to be bound by the revised terms.

These Terms shall be governed and construed in accordance with the laws of United States, without regard to its conflict of law provisions.
